Important Notice: ScandicData operates exclusively on a B2B basis. For legally binding terms governing the purchase of hardware, pricing, shipping, warranty, and refunds, please refer to our B2B General Terms and Conditions of Sale. These Terms of Service govern your use of the ScandicData website and the Cloud Monitoring Platform (SaaS).
By accessing the ScandicData website or using our cloud monitoring software platform, you agree to be bound by these Terms of Service. If you are entering into these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity. These Terms apply exclusively to business entities acting in a commercial or professional capacity.
ScandicData grants the subscriber a limited, non-exclusive, non-transferable, and revocable licence to access and use our cloud monitoring platform solely for internal business purposes. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. You must notify us immediately of any unauthorised access or security breach.
Users are strictly prohibited from using the platform to: transmit malicious code or software; attempt unauthorised access to our infrastructure or data; use data generated by the platform to develop competing services; or engage in any activity that violates applicable law. ScandicData reserves the right to suspend or permanently terminate access for any account found to be in breach of these conditions, without prejudice to any other available remedies.
All content, software code, visual interfaces, graphics, and trademarks provided by ScandicData are the exclusive intellectual property of 5K Studio LLC. The purchase of hardware or the subscription to our SaaS does not transfer any ownership rights in the underlying software, firmware, or intellectual property to the Buyer. Any reverse engineering, decompilation, or disassembly of our software is strictly prohibited.
While our IoT sensors are designed for high measurement accuracy — including for use in HACCP regulatory compliance monitoring — the ScandicData platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable EU and EEA law, ScandicData shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, business interruption, inventory spoilage, or regulatory fines resulting from hardware misconfiguration, network outages, or failure to act upon system alerts.
Nothing in these Terms of Service limits or excludes ScandicData's liability for: (a) death or personal injury caused by a defective product under EU Directive 85/374/EEC on Product Liability; (b) material damage to property exceeding €500 caused by a defective product under the same Directive; or (c) any other liability that cannot be excluded or limited under mandatory applicable law.
We aim to maintain 99.9% uptime for our cloud services; however, temporary interruptions for scheduled maintenance, unplanned outages, or upgrades may occur. We will endeavour to provide reasonable advance notice of planned maintenance. We reserve the right to modify, suspend, or discontinue features of the platform, providing reasonable prior written notice to active subscribers. ScandicData's liability for service unavailability is limited as set out in Section 5 above and in the B2B General Terms and Conditions of Sale.
